Force Majeure: In the event of an earthquake, flood, fire, storm, natural disaster, act of God, war, terrorism, armed conflict, labor strike, lockout, or boycott,Kalash Marine Corporation will not be considered in default under this agreement or held accountable for any halt, interruption, or delay in the performance of its duties under it.
Operation termination. Kalash Marine Corporation may stop running the website and distributing the products at any time, at its sole discretion, and without giving you prior notice.
Complete Agreement. This agreement replaces all previous agreements relating to the subject matter hereof and represents the entirety of your agreement with Kalash Marine Corporation.
Impact of the waiver. Kalash Marine Corporation will not be deemed to have waived any rights or provisions of this Agreement if it fails to exercise or enforce any of them. The other terms of this Agreement remain in full force and effect even if a court of competent jurisdiction finds any of its provisions to be invalid. The parties nevertheless agree that the court should make an effort to give effect to the parties' intentions as expressed in the provision.
The Bhavnagar Jurisdiction governs the law. The genesis of this website is in Bhavnagar, Gujarat. Notwithstanding its conflict of law principles, this Agreement shall be governed by the laws of the State of Bhavnagar. Unless in courts in the State of Bhavnagar, neither you nor Kalash Marine Corporation will initiate or pursue any lawsuit, proceeding, or claim to enforce the terms of this agreement, to recover damages for default or breach of this agreement, or otherwise arising under or by reason of this agreement. You agree to the jurisdiction and venue of such courts in connection with any action, suit, proceeding, or claim occurring under or as a result of this Agreement by using this website or placing orders for products. Hereby, you release yourself from any right to a jury trial resulting from this agreement and any associated agreements.
The statute of limitations. You acknowledge that any claim or cause of action relating to the use of the Website, the Products, or this Agreement must be made within a year of the occurrence of the claim or cause of action, or it will be permanently barred, regardless of any statute or law to the contrary.
Class action rights are waived. You hereby irrevocably give up any right you may have to combine your claims with those of others in a class action or other comparable procedural mechanism by signing this agreement. Every claim originating from, connected to, or arising out of this agreement must be made separately.
Termination. If Kalash Marine Corporation reasonably believes—in its sole discretion—that you have violated any of the terms and conditions of this Agreement, it may suspend your access to the Website. You will no longer be able to use the website after termination, and Kalash Marine Corporation reserves the right to cancel any pending product orders at its sole discretion and without prior notification to you. Kalash Marine Corporation retains the right to use any method it sees fit to stop illegal access to the Website in the event that your use of it is terminated. Unless Kalash Marine Corporation decides to end it at its sole discretion and without giving you notice, this agreement shall remain in effect indefinitely.
For domestic use. Kalash Marine Corporation does not guarantee that the products or website are suitable or accessible for use in places other than India. Users who visit the website from outside of India do so at their own discretion and risk, and they are solely responsible for adhering to any local laws that may be relevant.Assignment. Your rights and responsibilities under this agreement cannot be transferred to another person. In its sole discretion and without giving you any notice, Kalash Marine Corporation may assign its rights and duties under this agreement.
